1. Acceptance of Terms
By creating an AVA account and using the app, you agree to these Terms of Service. If you do not agree, do not use AVA.
2. Service description
AVA ("Available") is a peer-to-peer platform that connects individuals who cannot drive their own vehicle (e.g. after alcohol consumption) with individuals available to drive that same vehicle to a chosen destination.
AVA is a technology intermediary, NOT a transportation company, NOT a taxi/limousine company, NOT an employer of drivers. All rides are contracted directly between the rider (car owner) and the driver.
3. Eligibility
You must be at least 18 years old, hold a valid driver's license (if using AVA as a driver), and have a Google account to sign up.
Drivers additionally must:
- Hold a valid driver's license for the country of operation.
- Comply with all local laws regarding designated-driver services.
- Not be under the influence of alcohol, drugs, or any substance impairing driving ability.
- Have valid car insurance that covers driving another person's vehicle (verify with your insurer).
Riders additionally must:
- Own or be legally authorized to permit another person to drive the vehicle.
- Ensure their car has valid insurance covering third-party drivers.
- Provide accurate pickup/destination information.
4. The car belongs to the rider
AVA is explicitly designed for the driver to drive the rider's own vehicle. The rider retains all ownership responsibility, insurance liability, and legal obligation for the car during the ride. The rider must inform their insurer that a third party may drive the vehicle.
5. Payment structure
Each ride is priced automatically based on distance + country-specific tariff (approximately 50% of a local taxi).
- 90% of the fare = paid in cash directly by the rider to the driver at the end of the ride. AVA does NOT process, hold, or track this cash payment.
- 10% of the fare = voluntary donation by the rider to the AVA platform (Bogdan Tanase, Switzerland), made via bank transfer using the in-app QR code. This donation supports the maintenance and expansion of AVA and its mission to reduce driving under the influence.
Riders acknowledge that the 10% donation is not a service fee, is not refundable, and is made in gratitude to the platform creator.
6. Driver–Rider relationship
- Riders and drivers form a direct agreement for each ride. AVA is not a party to that agreement.
- AVA is not responsible for the behavior, condition, criminal record, or reliability of drivers or riders.
- Riders are responsible for verifying the driver's identity and license before handing over their car keys.
- Drivers are responsible for the safe operation of the vehicle during the ride.
- Any dispute between rider and driver is between those two parties.
7. Insurance & liability
- AVA does NOT provide insurance. Riders must ensure their car insurance covers third-party drivers.
- Drivers should verify their personal insurance covers driving another person's vehicle.
- AVA is not liable for accidents, damage to the vehicle, injuries, theft, or any incident during or related to a ride.
- The maximum liability of AVA to any user, for any claim, is limited to CHF 100 or the equivalent in the user's currency.
8. Prohibited conduct
You must NOT:
- Use AVA to transport illegal goods.
- Operate as a driver while impaired.
- Attempt to fake ride requests, ratings, or donations.
- Reverse-engineer, scrape, or abuse the API.
- Impersonate another user.
- Harass, threaten, or discriminate against other users.
- Use the app in a jurisdiction where designated-driver services are illegal.
Violation may result in immediate account termination and reporting to authorities.
9. Ratings
Riders and drivers rate each other 1–5 stars after each ride. Ratings are aggregated as a public reputation score. AVA may suspend accounts with sustained low ratings (< 3.0 average with 10+ ratings).
10. Account termination
You may delete your account at any time by emailing bogdan.tanase.ch@gmail.com. We may terminate accounts that violate these Terms, engage in fraud, or damage the platform's reputation, with or without notice.
11. Intellectual property
The name "AVA", the diamond logo, the slogan "You Drink – I Drive – Your Car", the app design, the codebase, and all related materials are the exclusive property of Bogdan Tanase. You may not reproduce, distribute, or create derivative works without written permission.
12. No warranties
AVA is provided "as is". We make no warranty about availability, uninterrupted service, accuracy of fare estimates, availability of drivers, or fitness for a particular purpose.
13. Governing law
These Terms are governed by Swiss law. Any dispute shall be resolved in the courts of Schaffhausen, Switzerland, to the extent permitted by mandatory local law of the user's residence.
14. Changes to Terms
We may update these Terms. Material changes will be notified in-app at least 30 days before taking effect. Continued use after the notice period is deemed acceptance.

16. Anti-drunk-driving mission
By using AVA, you support the mission of zero alcohol / zero drugs behind the wheel. Both riders and drivers pledge to promote responsible mobility and never drive while impaired.
